Welcome to Aspire Fit, These Terms & Conditions (“Terms”) govern your access to and use of aspire-fit.com and any subdomains, including but not limited to go.aspire-fit.com, app.aspire-fit.com, and offers.aspire-fit.com (collectively, the “Site”). The Site is owned and operated by Ben Petersen (“Aspire Fit,” “we,” “our,” or “us”).

By accessing or using the Site, creating an account, or purchasing any products or services from us (collectively, the “Services”), you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site or Services.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services. By using the Services, you represent and warrant that you meet this requirement and have the legal authority to enter into these Terms.

2. Health & Safety; Not Medical Advice

Informational Purposes Only. Aspire Fit provides fitness, nutrition, and lifestyle education and coaching. We do not provide medical care and our Services are not a substitute for professional medical advice, diagnosis, or treatment. Always consult a physician or other qualified health provider with questions about a medical condition.

Assumption of Risk. Physical activity involves inherent risks of injury. By choosing to participate in any exercise, program, challenge, or nutrition strategy suggested by us, you voluntarily assume all risks associated with such activities.

No Emergency Care. Do not use the Services for emergencies. In an emergency, call your local emergency number immediately.

Accuracy of Information. You are solely responsible for providing accurate, complete information about your health history, injuries, medications, and limitations.

3. Accounts & Security

Registration. You may need an account to access certain features. You agree to provide accurate, current information and to keep it updated.

Confidentiality. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use.

Account Actions. We may suspend or terminate your account for violation of these Terms or for suspected fraudulent or harmful activity.

4. Purchases, Subscriptions & Billing

Pricing & Taxes. Prices are shown at checkout and may change at any time prior to purchase. Applicable taxes and fees may be added.

Subscriptions & Auto-Renewal. If you purchase a subscription, it will auto-renew at the end of each term (e.g., monthly) until canceled. You authorize us (and our payment processors) to charge your payment method for the recurring fees.

Trials & Promotions. Any free trials or promotional pricing are offered at our discretion and may be subject to conditions or early termination.

Cancellations. You may cancel a subscription at any time via your account or by contacting us. Cancellation takes effect at the end of the current billing period; paid amounts are non-refundable except where required by law or as expressly stated at purchase.

Refunds. Unless a specific refund policy is provided for a product or program, all sales are final once digital content or services are delivered.

Chargebacks. You agree not to file chargebacks without first giving us an opportunity to resolve your concern. We reserve the right to contest improper chargebacks.

5. Coaching Conduct & Expectations

Participation. Your results depend on your adherence to training, nutrition, sleep, stress management, and other factors you control. We do not guarantee outcomes (e.g., weight loss, muscle gain, performance).

Communication. We strive to respond within normal business hours. Response times may vary based on program tier.

Program Changes. We may adjust programming based on your feedback and progress, at our discretion, to enhance safety and effectiveness.

6. Intellectual Property

Ownership. The Site, Services, programs, text, graphics, videos, images, logos, and other materials (the “Content”) are owned by Aspire Fit or our licensors and are protected by intellectual property laws.

Limited License. We grant you a personal, non-exclusive, non-transferable, revocable license to access and use the Content for your own non-commercial, personal use, in accordance with these Terms.

Restrictions. You may not copy, modify, distribute, sell, lease, publicly display, perform, or create derivative works from the Content without our prior written consent. Removing proprietary notices is prohibited.

User Content. If you submit, upload, or post content (e.g., check-ins, comments, photos, testimonials), you grant us a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, publish, and display such content for operating, improving, and promoting the Services. You represent you have the necessary rights to grant this license.

7. Acceptable Use

You agree not to:

Use the Services for unlawful purposes or in violation of these Terms;

Harass, threaten, or harm others, or share content that is defamatory, obscene, or infringing;

Attempt to gain unauthorized access to the Site, accounts, or systems;

Interfere with or disrupt the Site or Services, including by introducing malware, scraping, or excessive automated requests;

Share, resell, or make public any paid Content or materials without permission.

8. Third-Party Services & Links

The Site may link to or integrate third-party websites, apps, or services (e.g., payment processors, training apps). We do not control or endorse third-party services and are not responsible for their content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms and privacy policies.

9. Testimonials & Results Disclaimers

Testimonials appearing on the Site or in our materials reflect real experiences of clients but are not typical and do not guarantee that you will achieve the same results. Individual outcomes vary.

10. Communications & Consent

By providing your email address or phone number, you consent to receiving transactional and promotional communications from us (subject to applicable law). You can opt out of promotional emails at any time via the unsubscribe link. Transactional messages relating to your account or purchases may still be sent.

11. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and share your information. Please review it carefully.

12. Cookies & Similar Technologies

We use cookies and similar technologies to operate and improve the Site, analyze usage, and personalize content. By using the Site, you consent to our use of cookies as described in our Privacy Policy. You can manage cookie preferences through your browser settings.

13. Linking to Our Site; iFrames

You may link to our homepage or publicly available pages in a way that is fair and legal and does not damage our reputation or suggest any form of association, approval, or endorsement where none exists.

You must not frame the Site or create a browser or border environment around the Site without our express written permission.

14. Modifications to the Services

We may update, change, or discontinue any part of the Site or Services at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation.

15. Termination

We may suspend or terminate your access to the Services at any time if we believe you violated these Terms or for any reason at our discretion. Upon termination, your license to use the Content ends immediately. Sections that by their nature should survive (e.g., IP, disclaimers, limitations of liability, indemnification) shall survive.

16. Disclaimers

The Services and Content are provided “as is” and “as available” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be error-free, secure, or uninterrupted.

17. Limitation of Liability

To the maximum extent permitted by law, in no event shall Aspire Fit, Ben Petersen, our affiliates, or our suppliers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or goodwill, arising from or related to your use of (or inability to use) the Services, whether based in contract, tort, strict liability, or otherwise, even if advised of the possibility of such damages. Our total liability for any claim arising out of or relating to the Services shall not exceed the amount you paid to us for the Services in the three (3) months preceding the event giving rise to the claim.

18. Indemnification

You agree to defend, indemnify, and hold harmless Aspire Fit, Ben Petersen, and our affiliates, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your use of the Services, your User Content, or your violation of these Terms or applicable law.

19. Governing Law; Dispute Resolution

Governing Law. These Terms are governed by the laws of the State of Nebraska, USA, without regard to its conflict of law principles.

Venue. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Lancaster County, Nebraska, USA for any disputes that are not subject to arbitration.

Arbitration (Optional). At our election, any dispute, claim, or controversy arising out of or relating to these Terms or the Services may be resolved by binding arbitration on an individual basis, and not as a class or representative action, administered by a reputable arbitration provider under its rules. You and we waive any right to a jury trial. (If you prefer to omit arbitration entirely, remove this clause.)

20. Changes to These Terms

We may revise these Terms at any time. The updated Terms will be posted on the Site with an updated Effective date. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

22. Platform & Advertising Disclosures

Lead Ads & Consent. When you submit a form originating from Facebook, Instagram, or YouTube/Google (including Lead Ads, Instant Forms, or embedded forms), you: (a) represent that the contact information you provide is accurate and yours; (b) consent to receive emails, calls, and text messages (including via autodialer or prerecorded/AI voice where permitted) from Aspire Fit at the contact details you provide about products/services and promotions; and (c) understand that consent is not a condition of purchase. You can opt out of marketing emails at any time via the unsubscribe link and opt out of texts by replying STOP (HELP for help). Standard message/data rates may apply.

Behavioral Ads, Pixels & Tags. We use advertising pixels, tags, SDKs, and similar technologies (e.g., Meta Pixel, Google/YouTube tags) to measure ad performance, build/serve audiences, and personalize ads. These tools may track actions you take on our Site and associate them with your accounts on those platforms consistent with their policies. See our Privacy Policy for details and choices.

Custom Audiences & Matching. We may use hashed contact information to create “Custom Audiences” or similar segments on Meta and Google to deliver or exclude ads. You may be able to manage your ad preferences directly in those platforms’ settings.

User-Generated Content in Ads. If you comment on our posts, submit testimonials/reviews, or tag us, you grant Aspire Fit a non-exclusive, royalty-free license to use your submitted content (including your name/handle, text, images, and video) in our advertising and marketing, in any media, subject to applicable platform rules. If you prefer we not use a specific post, email us at [email protected] with a link/screenshot.

Testimonials & Typical Results. Client stories, before/after photos, and testimonials are individual experiences and do not guarantee results. Outcomes vary based on many factors (e.g., adherence, training history, health status). We do not make weight-loss or health claims that are not substantiated.

Promotions, Contests & Giveaways. Promotions we run on Facebook/Instagram or YouTube are governed by the official rules we publish for each promotion. Unless stated otherwise, promotions are void where prohibited, not sponsored, endorsed, or administered by Meta Platforms, Inc. or Google LLC/YouTube, and participants release those platforms from liability.

Third-Party Terms. Your use of Facebook, Instagram, YouTube, and Google services is subject to their respective terms and privacy policies. We do not control platform features, ad placement next to third-party content, or platform availability.

No Affiliation. Aspire Fit is not affiliated with or endorsed by Meta Platforms, Inc. or Google LLC/YouTube. Trademarks and logos remain the property of their respective owners.

Acknowledgment: By using the Site or Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
